Privacy policy
How Montwells collects, uses and protects personal data — under Montenegro's Law on Personal Data Protection and, for EU/EEA residents, the GDPR. Last updated 27 October 2026.
Who is responsible
The controller of your personal data is MONTWELLS D.O.O., a real estate brokerage company registered in Montenegro, with its seat at 4504 Luštica Bay Centrale, Radovići, Tivat, Montenegro, PIB / registration number 03609499. You can reach us at info@montwells.com or +382 69 100 303.
We process personal data in accordance with the Law on Personal Data Protection of Montenegro (Zakon o zaštiti podataka o ličnosti, as amended) and, where you are in the European Union or EEA, Regulation (EU) 2016/679 (GDPR). The supervisory authority in Montenegro is the Agency for Personal Data Protection and Free Access to Information (AZLP), Podgorica, azlp.me.
What we collect and why
Enquiries and alerts. When you send an enquiry, request a brochure, book a viewing or subscribe to property alerts, we store the details you give us — name, email, phone number, your message, the property or development it concerns, your language and the page you wrote from — in our customer system so an advisor can respond and follow your search. Legal basis: steps taken at your request before a contract, and our legitimate interest in answering you.
Clients. If you buy, sell or rent through us, we process the data needed to perform the brokerage contract: identity and contact details, property details, and the correspondence and documents of the transaction. Legal basis: performance of a contract.
Legal obligations. As a real estate broker, Montwells is an obliged entity under Montenegro's Law on the Prevention of Money Laundering and Terrorist Financing. Before a transaction we must identify you and, where required, your source of funds; this means taking a copy of an identity document and retaining it for the period the law prescribes. Legal basis: compliance with a legal obligation.
Marketing. We send market updates and new listings only with your prior, verifiable consent, which you can withdraw at any time using the link in each message or by writing to us.
We never sell or rent personal data.
Who receives your data
We share personal data only where necessary: with the other party, notary, lawyer, bank or developer involved in a transaction you have decided on; with service providers who host our website and customer system or send our email on our behalf, under contracts that bind them to confidentiality and to our instructions; and with public authorities where the law requires it. If a provider is located outside Montenegro, we transfer data only on a basis permitted by Montenegrin law — a country recognised as offering adequate protection, safeguards approved by the AZLP, or a legal exception such as the performance of your contract.
Cookies
This site sets only the cookies it needs to work: a session cookie for forms and security, and a preference cookie for your language and currency. We do not use advertising or cross-site tracking cookies. If we add analytics, it will be anonymised and switched on only after you accept it in a cookie notice. Embedded maps and videos (Google Maps, YouTube, Vimeo) may set their own cookies when you load them; those are governed by their providers' policies.
How long we keep data
Enquiry data is kept while your search is active and for up to two years after our last contact, then deleted. Transaction files are kept for ten years after the transaction, as required by Montenegrin accounting and anti-money-laundering rules. Marketing consents are kept until you withdraw them. Server logs are deleted after 90 days.
Your rights
You may ask us at any time to confirm whether we hold data about you, to see it, to correct or complete it, to delete it, to restrict its processing, to object to processing based on our legitimate interests, to withdraw a consent you have given, and to receive the data you gave us in a machine-readable format. Write to info@montwells.com; we answer within 15 days and in any case no later than one month. We may ask you to confirm your identity first. If you believe we have handled your data unlawfully, you may complain to the AZLP (Montenegro) or, if you live in the EU/EEA, to your national data protection authority.
We protect personal data with HTTPS encryption, access controls, two-factor authentication for staff and audit logs, and we will notify the AZLP and, where required, you of any breach likely to put your rights at risk within the deadlines the law sets.
